LEGALLY AND ACCURATELY MAKING A PRELIMINARY DETERMINATION OF WHETHER GENOCIDE HAS OCCURRED IN A LOCATION

DEFINITION
GENOCIDE
'The 1948 Genocide Convention, also known as the Convention on the Prevention and Punishment of the Crime of Genocide, defines genocide as acts committed with the intent to destroy, in whole or in part, a national, ethnical, racial, or religious group.'

From many reports since 1994 and decades after there is the impression
that the United States of America, with capital in Washington D.C.,
North America, somehow intentionally did not want to call the horrific
events commencing on 7th April 1994 a Genocide but rather preferred to
use the term 'Acts of Genocide'.
This appears plausible. However,
since the United States of America, with capital in Washington D.C.,
North America is governed by Law it would need to act legally and
lawfully in making such a determination even with the requirements of
the 1948 Genocide Convention.
From the information available to
me who write this physically, the United States of America with capital
in Washington D.C., North America did not have enough people on the
ground with the capability to make such a determination at the time. In
addition, if the United States of America, with capital in Washington
D.C., North America, had made a wrong determination, it would have been
quite serious.
Therefore, in my opinion, the refusal of the
United States of America, with capital in Washington D.C., North
America, to acquiesce to pressure to make a legal determination at the
time was not only wise and circumspect but very much legal and lawful.
To
accurately make such a determination would not have been feasible with
the United States trying to evacuate its citizens at the time. In addition information was not ubiquitous as now, decades later because of the Internet.
However, does it mean that nations should not make a legal determination in situations that appear as Genocide?
Certainly
nations, especially those that are signatories of the 1948 Genocide
Convention, should seek to legally make legal determination of genocide in such situations because that may help save hundreds of thousands and even millions of
lives.
How can nations legally do this?
With the following steps, this should be feasible for any nation desiring to do this.
1. Legally track casualty (especially deaths) numbers as they are made known from different sources and compare the figures.
2.
Conclude on the most accurate figures based on the credibility of the
source but also the proximity of the source to the location of the
occurrence of the killings and other important legal considerations.
3.
Legally track the geographical locations in that nation or location
where the suspected genocidal killings have occurred and or are
occurring. This means to put the casualty figures across specific
geographical locations where the killings occurred.
4. Legally find out which types of people are most populous in those particular locations.
5.
Make a preliminary assessment of possible patterns of killings across
such locations to legally and accurately determine whether certain areas
have a higher causality rate than others and which people are most
likely affected by that based on information legally available.
6.
In line with the 1948 Genocide Convention, make a press statement as to
the trends and patterns of casualties and, if clear that genocide is
likely occurring, make a preliminary legal and accurate determination
that the patterns and trends clearly show that genocide is likely
occurring. Legally make known the data used to make the legal and
accurate determination to the United Nations and other nations.

In this form, it is my opinion that a signatory of the 1948 Genocide Convention can operate in line with the Convention without putting its own nation at risk of making a wrong legal determination of whether genocide has occurred or not. Non-signatories of the 1948 Genocide Convention can also make the legal determination.
This is very important.
This
cannot be political, but a legal and accurate determination has to be
made only if the facts and legal data show that clearly.
